1. Acceptance of Terms

By accessing or using LaunchIt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

LaunchIt is an AI-powered landing page builder that allows users to create, publish, and host landing pages. The Service includes:

• AI-assisted page generation and refinement
• Static page hosting via CDN
• Email lead collection (relay-only)
• Custom domain support (Pro plan)

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for:

• Providing accurate registration information
• Maintaining the confidentiality of your password
• All activities that occur under your account

You must be at least 16 years of age to use the Service.

4. Free and Paid Plans

The Service offers a free tier and a paid Pro plan. Free accounts include limited credits, pages, and submissions per month. Pro plan details and pricing are available on the upgrade page. We reserve the right to modify plan features and pricing with reasonable notice.

5. Subscriptions and Billing

Pro plan subscriptions are billed monthly via Stripe. By subscribing, you authorize recurring monthly charges. You may cancel at any time; access to Pro features continues until the end of the current billing period.

6. Usage Limits

The Service enforces usage limits based on your plan, including but not limited to:

• Number of pages you can create
• AI generation credits per month
• Email submissions received per month
• Image uploads (file size and count)

Current limits are displayed in your dashboard and on the upgrade page. We reserve the right to adjust these limits with reasonable notice. Unused credits or submissions do not roll over between billing periods.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Create pages containing illegal, harmful, or fraudulent content
• Distribute spam, phishing, or misleading content
• Infringe upon intellectual property rights of others
• Distribute malware, viruses, or malicious code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Collect personal data from page visitors beyond what the Service provides

8. Uploaded Content

You may upload images to use in your landing pages. Uploaded images must:

• Be in supported formats (JPEG, PNG, GIF, or WebP)
• Not exceed 2MB per file
• Not contain illegal, obscene, or harmful content
• Not infringe on the rights of others

We reserve the right to remove uploaded content that violates these Terms.

9. AI-Generated Content

The Service uses AI to generate landing page content. You acknowledge that:

• AI-generated content is provided "as-is" without guarantees of accuracy
• You are solely responsible for reviewing, editing, and approving all content before publishing
• You retain ownership of the content you create using the Service
• We do not claim ownership of your content

10. Content Moderation

We reserve the right to remove any published page that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or inappropriate. We may suspend or terminate accounts that repeatedly violate these Terms.

11. Intellectual Property

The Service, including its design, code, and branding, is owned by LaunchIt. You retain all rights to the content you create. By publishing a page, you grant us a limited license to host and serve that content as part of the Service.

12. Service Availability

We strive to keep the Service available at all times, but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may request account deletion by contacting us at [email protected]. Upon termination:

• Your published pages will be unpublished and removed
• Your account data will be deleted
• Active subscriptions will be cancelled

14. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

15. Limitation of Liability

To the maximum extent permitted by law, LaunchIt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless LaunchIt from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
